Please read these legal Terms & Conditions carefully before enrolling in any classes, hiring tutors, or using the educational services provided by Smart Education.

Welcome to Smart Education (smartedu.my), founded, owned, and managed by Shahbid Hussain. By accessing this platform, submitting registration forms, booking physical or online classes, or using any associated services, you agree to be legally bound by these Terms & Conditions.

Core Scope & Applicability:

  • These terms apply to all enrolled students, parents, legal guardians, tutors, and general website visitors.
  • Enrolling a minor (under 18 years of age) implies full parental or legal guardian consent and obligation to these terms.
  • If you disagree with any clause or provision set forth herein, you must immediately discontinue using our services.
  • Smart Education reserves the right to amend or revise these terms at any time without prior individual notice.
  • Continued participation in educational sessions following published updates constitutes acceptance of the new terms.
  • These terms operate alongside our Privacy Policy and specific course enrollment agreements.
  • Headings are for structural organization and scannability only and do not affect legal interpretation.

To maintain high educational standards and operational integrity, all payments are governed by strict guidelines:

  • All registration forms, identity verification details, and initial fee deposits must be completed prior to class commencement.
  • Tuition fees must be paid strictly in advance on or before the due date specified on the invoice or payment notice.
  • Registration fees, administrative fees, material charges, and platform service fees are strictly non-refundable under any circumstances.
  • Monthly tuition payments once processed are non-refundable, non-transferable, and cannot be carried forward to future months unless authorized in writing by management.
  • Late fee payments beyond 7 calendar days from the due date may result in immediate suspension of tuition services and portal access.
  • Smart Education reserves the right to modify tuition fees, package structures, or promotional pricing with a minimum 14-day prior notice.
  • Parents and students are responsible for maintaining digital payment receipts, transaction IDs, and bank transfer confirmations.
  • Unattended sessions due to personal reasons, family events, or student vacations are not exempt from monthly tuition charges.
  • Payments made via third-party online banking or payment gateways are subject to processing fees where applicable.
  • In the event of dishonored checks or failed online bank transfers, administrative bank charge penalties will apply.

Consistency and punctual attendance are essential for academic success:

  • Students are required to join or attend scheduled classes on time. Tutors are not obligated to extend sessions for late arrivals.
  • For private (1-on-1) sessions, notice for rescheduling or cancellation must be submitted at least 24 hours prior to class time.
  • If a student fails to attend a session without 24 hours prior notice, the class is deemed completed, and full tuition for that session remains chargeable.
  • For group classes, missed sessions will not be replaced, refunded, or rescheduled under any circumstances.
  • If a tutor cancels a session due to illness or emergency, Smart Education will arrange a replacement tutor or schedule a makeup class.
  • Makeup classes must be utilized within 30 calendar days of the original scheduled date or they will expire.
  • Smart Education reserves the right to adjust class timetables, merge group sessions, or reassign tutors to ensure teaching quality.
  • Students attending online classes must maintain a stable internet connection, functional audio/video equipment, and a quiet learning space.
  • Technical failures on the studentโ€™s end (e.g., poor Wi-Fi, hardware failure) do not qualify for class refunds or free replacement sessions.
  • Attendance records maintained by Smart Education administrators and tutors shall serve as official proof of class completion.

We enforce a strict safe-learning environment across all digital and physical environments:

  • Students and parents must interact with tutors, staff, and peers with dignity, respect, and professional courtesy.
  • Cyberbullying, verbal abuse, hate speech, sexual harassment, discrimination, or offensive behavior will result in immediate service termination without refund.
  • Inappropriate classroom attire, vulgar language, or disruption during live online classes is strictly prohibited.
  • Direct private soliciting, private financial dealing, or negotiating outside contracts with Smart Education tutors without platform knowledge is strictly forbidden.
  • Bypassing Smart Education to hire tutors privately constitutes a breach of contract and may lead to legal penalties.
  • Students must complete assigned homework, practice sheets, and revision assessments in a timely and sincere manner.
  • Smart Education reserves the right to issue official warnings or immediately ban users who breach behavioral guidelines.

All content provided by Smart Education is protected under intellectual property laws:

  • All course notes, PDF worksheets, exam practice papers, custom formulas, slide presentations, and video recordings remain the sole property of Smart Education.
  • Enrolled students are granted a non-exclusive, non-transferable, limited license to view study materials for personal educational use only.
  • Copying, scanning, re-selling, uploading to public drives, or sharing educational resources with non-enrolled individuals is illegal.
  • Unauthorized screen-recording, downloading, or public broadcasting of live online sessions is strictly prohibited.
  • Smart Education logos, trademarks, domain names, website designs, and brand collateral cannot be reproduced without prior written permission.
  • Violation of intellectual property rights will result in immediate account deletion and legal prosecution under Malaysian copyright laws.

Specific regulations governing physical in-person and home tuition arrangements:

  • For home tuition, a parent, legal guardian, or designated adult must be present at home throughout the entire session duration.
  • Home environments must provide a safe, well-lit, quiet, and adequate study area free from domestic disruptions.
  • Parents must ensure the physical safety and respectful environment for tutors arriving at their residence.
  • Tutors reserve the right to leave the premises immediately if they encounter unsafe, hostile, or inappropriate environments, with full tuition charged.
  • Smart Education conducts identity background checks on tutors but encourages parents to verify credentials upon initial meeting.
  • Damages caused to tutor belongings or center facilities by students must be compensated by the parent/guardian.

Transparency regarding learning outcomes and tutor duties:

  • Smart Education selects qualified and tested tutors; however, academic score improvements depend significantly on student effort, practice, and attendance.
  • Smart Education does NOT guarantee specific exam grades, school entrance admissions, or pass percentages.
  • Tutors are independent educators operating under Smart Education platform guidelines and academic standards.
  • If a student/parent is unsatisfied with a tutorโ€™s teaching style, they may request a tutor replacement through administration.
  • Tutor replacement requests will be processed within 5 to 10 working days subject to subject and schedule availability.

Legal boundaries governing service liabilities:

  • Smart Education is not liable for indirect, incidental, special, or consequential damages resulting from platform usage or service interruption.
  • We are not responsible for technical outages caused by internet service providers (ISPs), power grid failures, or third-party software glitches (e.g., Zoom, Google Meet).
  • Smart Education accepts no liability for loss of personal items or physical injuries during in-person classes, except where mandated by law.
  • Total legal monetary liability of Smart Education for any claim shall not exceed the actual monthly tuition fee paid for the specific month in question.

  • Smart Education shall not be held liable for failure or delay in delivering classes due to events beyond reasonable control.
  • Force Majeure events include natural disasters, floods, severe weather, pandemics, government lockdowns, civil unrest, or major internet outages.
  • In case of physical school/center disruptions, classes will seamlessly transition to online live virtual classrooms.

  • Smart Education reserves the right to suspend or terminate student enrollment immediately for unpaid tuition, misconduct, or copyright breaches.
  • Parents wishing to discontinue classes must provide a minimum of 14 days written notice prior to the start of the next billing cycle.
  • Failure to provide timely withdrawal notice will obligate payment for the upcoming monthly billing cycle.

  • These Terms & Conditions are governed, construed, and enforced in accordance with the laws of Malaysia.
  • Any disputes, controversies, or claims shall first be attempted to be resolved amicably through good-faith mediation with Smart Education management.
  • If mediation fails, disputes shall fall under the exclusive jurisdiction of the competent courts located in Malaysia.
